Liability Waiver and Release

You understand that indoor golf practice, simulator use, putting and putting-green activities, smart green technology, hitting bays, golf clubs, golf balls, hitting mats, and general facility activity involve inherent risks, including but not limited to:

• Contact with golf clubs, balls, or equipment.
• Slips, trips, falls, collisions, and impact injuries.
• Muscle strains, joint injuries, and repetitive-motion injuries.
• Equipment failure or damage during normal use.
• Injuries caused by other guests, including children in the facility.

You voluntarily accept and assume all such risks, whether known or unknown, that arise out of or relate to your participation.

To the fullest extent permitted by law, you release, waive, discharge, and agree not to sue Zest Golf, its owners, members, employees, contractors, instructors, affiliates, sponsors, landlords, and equipment providers (the "Released Parties") from any and all claims, demands, losses, damages, and causes of action arising out of or relating to your use of the facility, equipment, technology, or participation in any session, event, or challenge, except where prohibited by law.

You agree to follow all posted facility rules, signage, safety markings, and the reasonable instructions of Zest Golf staff. Failure to do so increases risk to you and others and may result in immediate removal from the facility.

You agree to pay the reasonable cost of repair or replacement for any damage to facility property, equipment, screens, sensors, surfaces, smart green technology, furnishings, or club rentals caused by your misuse, negligence, or willful conduct, or by guests you bring to the facility.

You represent that you are physically able to participate and have no medical condition that would make participation unsafe. If you are unsure, you should consult a medical professional before participating.

You authorize Zest Golf and its staff to take reasonable steps to obtain emergency medical care for you if needed, at your sole expense. The Released Parties are not responsible for the cost or outcome of any medical treatment.

Guests under 18 may only participate with the consent of a parent or legal guardian who is present at the facility, has read this Waiver, and accepts it on the minor's behalf. The parent or guardian is responsible for supervising the minor and is responsible for damage or injury caused by the minor.

You agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of your violation of this Waiver, your misuse of the facility or equipment, or your negligent or wrongful conduct at the facility.

You acknowledge that Zest Golf may capture photos, video, audio, or other recordings inside the facility for marketing, promotional, social media, and event-recap purposes. You grant Zest Golf a non-exclusive, royalty-free license to use such media in connection with the business. If you have concerns about appearing in marketing media, please contact info@thezestgolf.com and we will make reasonable efforts to accommodate your request.

This Waiver is governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Venue for any in-court action lies in the state or federal courts located in Harris County, Texas, unless otherwise required by law.

When you register, book a session, or check in at the facility, you may be asked to confirm the following acknowledgement:

I have read, understood, and agree to the Zest Golf Houston Liability Waiver and Release, including the assumption of risk, release of liability, responsibility for damage, medical and emergency provisions, indemnification, and photo/video release. I confirm I am at least 18 years old, or that I am the parent or legal guardian of the participating minor and accept these terms on their behalf.
