Waiver & Release of Liability

1. Assumption of Risk

Indoor golf involves real, physical activity. Swinging clubs, striking balls, using simulators, walking on putting surfaces, and moving through the facility carry inherent risks — including but not limited to contact with clubs or balls, slips and falls, muscle and joint injuries, equipment failure, and contact with other guests. I voluntarily assume all such risks, known and unknown, related to my use of Zest Golf bays, simulators, putting greens, clubs, balls, mats, and any other facility activity.

2. Release of Liability

To the fullest extent allowed by Texas law, I release and discharge Zest Golf, its owners, employees, contractors, and affiliates from any and all claims, demands, or causes of action arising from my participation in activities at the facility — including claims based on ordinary negligence — except for conduct that cannot lawfully be released.

3. Rules and Staff Instructions

I agree to follow all posted rules, signage, and reasonable instructions from Zest Golf staff. I will not swing clubs outside designated areas, will respect bay boundaries, and will keep children with me at all times.

4. Responsibility for Damage

I am responsible for damage I cause to the facility or its equipment through misuse, horseplay, or negligence, and I authorize Zest Golf to charge my payment method on file for reasonable repair or replacement costs.

5. Medical Conditions and Emergency Care

I confirm I am physically able to participate, or have chosen to participate despite known conditions. If I experience a medical issue at the facility, I authorize Zest Golf to call emergency services on my behalf and agree to be responsible for any resulting medical costs.

6. Minors

A parent or legal guardian must sign this Waiver on behalf of any guest under 18, accepts all terms above for the minor, and agrees to supervise the minor while at Zest Golf.

7. Indemnification

I agree to indemnify and hold Zest Golf harmless from any claims brought by third parties as a result of my acts or omissions at the facility.

8. Photo, Video, and Media Release

Zest Golf may capture photo or video at the facility and during events for marketing, social media, and promotional purposes. By visiting, I grant Zest Golf a non-exclusive, royalty-free license to use my likeness in such materials. If you would prefer not to appear in Zest Golf marketing, please email info@thezestgolf.com and let us know.

9. Governing Law

This Waiver is governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.

10. Agreement

Suggested checkbox language for booking and registration flows:

“I have read and agree to the Zest Golf Waiver & Release of Liability, and (if booking for a minor) I am the parent or legal guardian and accept this Waiver on the minor’s behalf.”
