Terms of Service

By joining the waitlist, booking a session, entering the facility, or otherwise using the Services, you agree to these Terms and to our Privacy Policy and Waiver. If you do not agree, please do not use the Services.

We may update these Terms from time to time as the business launches and evolves. We will update the "Last updated" date above and, where appropriate, notify waitlist members by email. Continued use of the Services after changes constitutes acceptance of the updated Terms.

You must be at least 18 years old to create an account, join the waitlist, book a session, or enter into agreements with Zest Golf. Guests under 18 may use the facility only with a participating parent or legal guardian who accepts these Terms and the Waiver on their behalf.

Up to 4 people may participate together as guests at the facility. Additional age, supervision, or group-size rules may apply for specific events or challenges.

Bay time, VIP rooms, putting green sessions, and event slots may be reserved on an hourly basis. Reservation availability, duration, and combo packages will be detailed at booking.

Sessions begin and end at scheduled times. Late arrivals shorten the booked session. Equipment, technology, and facility features are provided on an as-available basis.

You agree to follow all posted facility rules and the instructions of Zest Golf staff. You agree not to:

• Engage in unsafe, reckless, disruptive, harassing, or illegal behavior.
• Damage or misuse equipment, technology, surfaces, or the facility.
• Bring weapons, illegal substances, or hazardous items onto the premises.
• Use the facility while impaired in a way that creates risk to yourself or others.

Zest Golf reserves the right to refuse service, end a session, and remove any guest who violates these Terms or facility rules, with no refund.

You are responsible for damage to clubs, balls, mats, screens, sensors, putting surfaces, smart green technology, furnishings, or other facility property caused by your misuse, negligence, or willful conduct, or the conduct of guests you bring. Zest Golf may charge for repair or replacement at reasonable cost.

Zest Golf charges by the hour and offers hourly package options. The more hours purchased, the lower the effective hourly rate may be. Rates can be as low as $20/hour. Final pricing tiers, taxes, fees, and package terms will be presented before checkout.

Cancellation, rescheduling, no-show, and refund policies will be presented at booking. By completing a reservation, you authorize Zest Golf to charge the applicable amounts to your selected payment method.

Each registered waitlist account receives 3 free Hole-in-One Challenge attempts at the Katy grand opening. Additional attempts may be earned by purchasing selected hourly combo packages. The challenge takes place in person at the Zest Golf Houston facility during the grand opening period and is not playable online.

The prize pool is $10,000. If multiple participants make a hole-in-one within the eligible challenge window, the prize pool will be split equally among all successful participants. Final challenge rules, timing, eligibility, equipment, distance, and verification procedures will be finalized and posted before opening, and participation requires agreement to venue rules and the Waiver.

Promotions, opening offers, and accessory discounts may be offered to waitlist members from time to time and may be subject to additional terms.

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

These Terms and any disputes related to them or to the Services are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Venue for any in-court action lies in the state or federal courts located in Harris County, Texas, unless otherwise required by law.

The parties will first attempt in good faith to resolve any dispute informally by contacting info@thezestgolf.com. If the dispute is not resolved, the dispute resolution mechanism (including any arbitration or class-action waiver terms) will be set forth in a future update to these Terms before opening. This section is a placeholder pending final attorney review.

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Zest Golf disclaims all implied warranties and limits its liability for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services or the facility.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be reformed to the minimum extent necessary to make it enforceable.
